Grandparent rights in Georgia is an available option for grandparents seeking reasonable visitation rights.  Grandparent custody rights can also be granted under specific circumstances.


Georgia family law courts may grant Georgia grandparent rights visitation if the following criteria is met.


The court will award a grandparent reasonable visitation if:

Potential or actualized damage to child’s health

Grandparent visitation is in child’s best interest.

In ruling about whether the child will be harmed by denying visitation, courts consider the following:

if child has resided with grandparents for 6 months or more

if grandparent provided financial support for more than 1 year

an established pattern of regular grandparent visitation, and

any other circumstances that indicate emotional or physical harm would be reasonably likely if  grandparent visitation was denied.
