Massachusetts Grandparent Rights

Massachusetts grandparent rights visitation is problematic for grandparent seeking visitation rights while parents of grandchildren are both married and living together.  A petition of Massachusetts family law courts for grandparent rights for visitation would not be approved.

Grandparents can petition for Massachusetts grandparent rights if child’s parents are divorced or separated, parent has passed away, or if the child was born outside the bounds of a marriage contract.

In Massachusetts grandparents may not file for visitation of grandchildren living in an intact family. That means that if the parents of the grandchildren are married and living together, they can make any decision they like about contact with grandparents.

Massachusetts grandparent rights for visitation and / or custody is usually deemed valid when grandparents can reasonably prove both best interests of child and harm caused by restricting contact with grandparents.
