Pursuant to C.R.S. 19-1-117(1), any Colorado grandparent or great-grandparent may seek Colorado grandparent visitation rights when there has previously been one of the following:
A previous temporary or full custody order while grandchildren(s) parents were dissolving a marriage contract.
Parental responsibilities have previously been issued to a non-parent or a child has been placed outside of the parent’s home (excluding adoption).
The child's parent(s), who is the child of the grandparent or grandchild of the great-grandparent, has died.
No Colorado Grandparent Rights Visitation Without A Prior Custody Case
Look at the limitations above. If the child is still living with both parents and there has never been a custody order, the grandparent or great-grandparent lacks legal precedence to seek an order for grandparent visitation. Simply living apart is insufficient.
