A summary of Montana grandparent rights for visitation and / or custody
A parent has lost custody due to abuse or neglect.
The parent, although able, has not contributed to the child's support for a year.
The parent is in violation of an order to support the child
The child has been maintained by a public or private agency for one year without the parent contributing to the child's support.
Most times the Montana family law courts will use a guideline for what’s in the best interests of the grandchild that includes some sort of established previous relationship with grandparents and unfortunate circumstances for child’s parents.
